Terms of Service

These Terms of Service ("Terms") govern your use of the Carter website at cardsbycarter.com (the "Service"), operated by Carter ("we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Carter is a free, informational comparison tool. You enter estimated spending amounts, and Carter calculates which credit cards in our catalog would earn the most rewards for that spending. The Service is currently offered as a beta, and features may change, break, or be discontinued at any time without notice.

Carter is not a bank, lender, card issuer, broker, credit repair organization, or financial, legal, or tax advisor. The Service provides mathematical estimates for informational purposes only. Nothing on the Service constitutes financial advice or a recommendation that you apply for, open, close, or use any financial product. Your use of the Service does not create an advisory or fiduciary relationship. You are solely responsible for your financial decisions, and you should consider consulting a qualified professional before making them.

Rewards figures shown by the Service are estimates. They depend on the spending amounts you enter, on assumptions we make (including assumed point and mile valuations), and on card terms in our catalog that may be incomplete or out of date. Card rates, fees, rewards rates, welcome bonuses, and other terms change frequently and without notice, and we do not guarantee that any information on the Service is accurate, complete, or current. Always confirm current terms directly on the issuer's website before applying for any card.

We make no representation about your likelihood of being approved for any card. Applications are made directly with the issuer, under the issuer's own criteria and terms.

As of the effective date above, Carter receives no compensation from any card issuer, bank, or affiliate network for the cards shown, and compensation plays no role in how cards are ranked. Rankings are based solely on the calculated rewards for the spending you enter. If this changes in the future, we will disclose it clearly on the Service and update these Terms.

The Service links to third-party websites, including card issuers' application pages. We do not control those websites and are not responsible for their content, terms, or privacy practices. Any application you submit, and any account you open, is governed solely by your agreement with the issuer.

All credit card names, bank names, logos, card artwork, and related trademarks displayed on the Service are the property of their respective owners. Their appearance on the Service is for identification purposes only and does not imply any affiliation with, endorsement by, or sponsorship from those owners.

You agree not to:

• use the Service for any unlawful purpose;
• scrape, crawl, or systematically extract data from the Service, or use automated means to access it other than standard search engine indexing;
• reverse engineer, decompile, or otherwise attempt to derive the Service's underlying algorithms, models, data sets, or valuation assumptions, except to the extent such a restriction is prohibited by applicable law;
• systematically submit queries to reconstruct or approximate our catalog, calculations, or rankings, or use the Service or its output to build, train, or improve a competing product, data set, or model;
• interfere with or disrupt the Service, or attempt to access it by any means other than the interfaces we provide;
• misrepresent the Service's output as advice or as your own product.

The Service — including its design, text, software, and the calculations and presentation of results, but excluding third-party trademarks and card data published by issuers — is owned by us and protected by applicable intellectual property laws. We grant you a limited, revocable, non-exclusive license to use the Service for personal, non-commercial purposes.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ITS RESULTS WILL BE ACCURATE OR RELIABLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REWARDS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE — INCLUDING ANY DECISION TO APPLY FOR OR USE A FINANCIAL PRODUCT BASED ON INFORMATION FROM THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Service or your violation of these Terms.

We may modify or discontinue the Service, or update these Terms, at any time. If we make material changes to these Terms, we will update the effective date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
